Auction Terms & Rules
All auctions conducted by Southwest Auction Service, LLC are subject to the following terms and conditions. By participating in any auction as a buyer or seller, you agree to be bound by these terms.
General Rules
- All items are sold as-is, where-is, without warranty or guarantee of any kind.
- The auctioneer reserves the right to reject any bid and to determine the successful bidder in the event of a dispute.
- All sales are final. No refunds or exchanges unless otherwise stated.
- Buyers are responsible for inspecting all items prior to bidding.
- Payment is due in full on auction day unless prior arrangements have been made.
- Accepted payment methods: cash, approved check, or other methods announced at the auction.
- Items not picked up within the stated time will be subject to storage fees or disposal at the auctioneer's discretion.
Dog Auction Specific Rules
- Buyers bidding in person need a valid government-issued photo ID. To bid without attending, submit an Absentee Bid Sheet at least one day before the auction.
- Buyers purchasing breeding stock must hold a valid USDA license where required by law.
- Health certificates and registration papers will be provided where applicable.
- Sellers warrant that all consigned dogs are in good health and free of known communicable diseases at the time of consignment.
- Sellers are not permitted to bid on their own consigned animals.
Conditions of Sale
For Sellers
- The seller commissions Southwest Auction Service to sell consigned items at public auction to the highest bidder.
- The seller covenants that they are the legal owner of all consigned items and that all items are free of liens and encumbrances.
- Commission rates and fees will be outlined in the consignment contract.
- Settlement will be made no later than 30 days after the auction date.
- All auction proceeds are held in escrow until settlement.
- Reserve bids may be permitted at the auctioneer's discretion and must be agreed upon in advance.
For Buyers
- A buyer's premium may apply and will be announced prior to the auction.
- Buyer assumes all risk for purchased items once the auctioneer announces "sold."
- Buyers are responsible for all applicable sales tax.
- Failure to pay for purchased items may result in forfeiture of bidding privileges at future auctions.
Indemnification & Liability
All participants (buyers and sellers) agree to indemnify, defend, and hold harmless Southwest Auction Service, LLC, its owners, employees, agents, and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs, and expenses arising from or related to the auction.
Southwest Auction Service, LLC acts as an agent for the seller and is not responsible for the condition, quality, or fitness of any item sold at auction.
Classified Advertising
These terms apply to classified ads placed on swaauction.com. Submitters accept them when they place an ad.
Review & Moderation
- Every ad is reviewed by our staff before it appears on the site. Paying the listing fee submits an ad for review; it does not publish it.
- Southwest Auction Service, LLC may edit, decline, or remove any ad at its sole discretion, before or after it is published.
- Ads found to be fraudulent, dishonest, misleading, falsified, or unlawful are rejected or removed, and the listing fee is not refunded.
- The listing fee pays for the review and placement of an ad. It is not contingent on the ad being approved, on any response to the ad, or on any sale resulting from it.
Submitter Responsibilities
- Submitters warrant that the information in their ad is truthful and accurate, and that they have the legal right to sell what they list.
- Submitters are responsible for complying with all laws that apply to what they advertise, including any licensing, health, registration, or transport requirements.
- Contact details shown on an ad are provided by the submitter for buyers to use.
Platform Role & Liability
Southwest Auction Service, LLC provides classified advertising space only. It is not a party to any transaction that arises from an ad, does not verify listings, submitters, or respondents, and does not inspect, guarantee, or take custody of anything advertised.
Dealings arising from a classified ad are solely between the parties involved. Southwest Auction Service, LLC is not responsible for the accuracy of any ad, the condition, quality, legality, or safety of anything advertised, or the conduct or outcome of any resulting dealing. Its liability in connection with a classified ad is limited to the listing fee paid for that ad.
