Dog Consignment Contract

Conditions & Requirements (items 1–18)
- There is a $25.00 per dog entry fee to be paid prior to auction date. Any dogs consigned late (after the sale is marked full and/or the catalog has been numbered) carry an additional $10 fee per dog.
- Each seller will be charged 10% commission on dog sales & 15% on kennel supplies. If selling kennel supplies, please provide an itemized listing so we can advertise it on the auction flyer. Commission fees are deducted from your check. Entry fees and commissions are nonrefundable.
- A reserve may be placed on any dog for an additional charge of $10.00 per dog, placed at the time of consignment. YOU WILL NEED TO BE HERE TO REPRESENT YOUR DOG WHEN THE DOG SELLS, OR DESIGNATE SOMEONE TO REPRESENT YOU AND YOUR DOG. Southwest Auction takes no responsibility for dogs sold under reserve price when no one is present to represent them.
- All dogs must be clean, healthy, easily handled (no biters, please), and good representatives of the breed. Dogs that do not meet these criteria will be refused for sale. Entry fees are nonrefundable. If a dog already cataloged is pulled from the auction there is no refund; any entry fees not prepaid on pulled dogs will be invoiced.
- All dogs must be MICROCHIPPED. If you need microchips, contact the office and we will assign them for you at a cost of $10 per chip.
- ID tags with catalog numbers will be mailed to sellers with more than 25 dogs once we receive all catalog info; sellers with fewer than 25 dogs pick up tags at drop-off. Place the tag around the dog's neck with a collar or heavy string. No zip ties or chains. $1.00 per tag is deducted from your check.
- There must be one 9x12 envelope per dog containing the dog's registration paper, rabies certificate, shot records, copy of health certificate (if out of state), and any other paperwork to pass to the buyer. Provide an inventory (running) list on USDA form #7006 made out to Southwest Auction. All out-of-state dogs require a health certificate. All dogs over 12 weeks must be current on rabies vaccinations.
- Have your dogs at the auction site no later than 8am on auction day. You are responsible for unloading, caring for, and feeding your own dogs; we are not responsible for accidents or escaped dogs. If bringing dogs the night before, feed/water/care for them before 7:30am on auction morning. We usually have 24-hour security, so late deliveries are fine. We provide bowls.
- When you receive your contract to consign, fill it out and send it back immediately; sale dates are first come, first serve. We must have a photocopy of each dog's registration paper at the time of consignment; you will not receive your auction information until we have your dogs' information for the catalog. Write extra comments on the registration copy. Hand-written registration info is not accepted unless the dog is unregistered due to errors.
- All sellers must guarantee each dog to be brucellosis free for at least 40 days after the auction. Complaints must be worked out between buyer and seller. The guarantee is void if the buyer has not had the dog tested within 7 days of the auction by a licensed veterinarian. (Testing prior to auction benefits the seller; bring the negative test statement.)
- It is helpful for the seller to be present to answer questions about their dogs. If the seller leaves the auction and there is no reserve price, the dog will be sold no matter the price.
- The seller guarantees their privileges have not been denied by the registration club in which their dog is registered, and agrees to assist the buyer with any complications registering the dog into the buyer's name. If ownership cannot be transferred due to error or fault of the seller, the seller agrees to fully refund the buyer the price of the dog.
- At the time of consignment, provide any information that may help your dog sell at a higher price (O.F.A. certification, champions in the pedigree, negative brucellosis tests, ultrasound pregnancy test, etc.). These are included in the catalog, with supporting documents in the envelope on sale day.
- Any deliberate attempt to defraud or misrepresent your dog, or deliberately selling a dog with a contagious disease, may result in a court dispute. The buyer may obtain a copy of this agreement upon request.
- All sellers are paid by check, mailed approximately 7 days after the auction to give buyers' checks a chance to clear. Checks are held if a dispute arises or if registration papers are not provided on auction day. Money may be held in escrow until a dispute is settled; Southwest Auction helps only as an advisor and is not responsible for payment until the dispute is settled between buyer and seller.
- Southwest Auction Service is in no way responsible for lost or stolen articles, INCLUDING BUT NOT LIMITED TO MY DOG/DOGS, and is not liable for injury to man or animal. Caging is provided for your convenience but not required; you are welcome to carry your own dogs to the auction block and tend to them throughout the auction.
- We only accept full kennel dispersals, complete breed sellouts, and dogs under seven years of age not included in those. This is not a dumping ground for old and/or nonproductive dogs.
- I verify that I am USDA licensed and can provide a current and valid license or I affirm I fall under the category of a hobby breeder (less than 4 breeding age females). I take full responsibility for any consequences imposed by USDA if I have falsified any information to Southwest Auction.

All puppies must be over 8 weeks of age to be sold individually. Dogs must be 7 years or under, except complete kennel dispersals and breed sellouts.
